What kind of letter can I send to someone regarding a lawsuit I was in a car accident in 2006. My car was t-boned by a semi. My pelvis was crushed, my right femur broken, as well as both feet, and I had a head injury. I was in the hospital and rehab for a month before coming home. I want to write a letter to the person responsible to avoid a lawsuit. I have all my records as well as the accident report which this person is at fault. |

It probably would be best if you did not directly contact the other parties involved in the accident at this time. Do not write them a letter, email, call or visit them.
You have suffered life-threatening injuries which put you in the hospital for a month, and will likely undergo a long period of recovery measured in months, even years. Take time to rest and recover for the time being.
You've said you want to avoid a lawsuit, although you were not the party at fault. That is a very forgiving attitude, but you are not protecting your interests, your future by trying to stay out of court. Perhaps your insurance has covered your current medical bills, but who will pay in years to come if your recovery is not 100%? If you can't work, or must find a new line of work, because of these injuries, how will you earn a living? Consider your future; consider your children's future. Now is the time to get the professionals on the job, professionals working for YOU and your future.
Leave the resolution of the case to your attorney. If you do not have your own attorney (NOT your insurance company's attorney) get one now. If you're not sure how to find an attorney, check out your state's bar online. Many state bars have a free referral service to member attorneys specializing in the area of law you need, often with a deeply discounted rate on the initial consultation ($45 in NV.) If you are worried about paying the attorney, stop. Many (if not most) personal injury attorneys will work on contingency with no fee charged up front. Most important here is that you have someone knowledgeable and aggressive, who will fight for YOUR interests, including your future needs.
