Guardianship or Custody of an Adult? Here is the story. My fiance which I just proposed to her about 2 weeks ago was in a car accident last novemeber, she is 21 and was 21 when it happened. Her mom says she has custody of her because she was in a coma and still cant do everything herself. Walk without a walker and work right now. Amongst some other things, she had 2 brain injuries and is on a good amount of medication. Now is it custody her mom has or guardianship? Im asking because her mom wont let us do anything, sleep over....come to my house by herself. Saying we are moving to fast, but I have known her a long time before the accident and started dating after. Anyone know how I can get around this, she is basically treating her like a child. Please help! State is Maine. |

I will not say your moving to fast if you have known her prior to her accident, however I can see the mothers concern, had you beeen dating prior to the accident I could understand more of what your saying, however I will tell you what you want to no, the mother when her daughter was in a coma could of filed for power of attorney over her daughter and to be her legal guardian, what then happens when her daughter came out of her come if in sound mind and body she can terminate the power of attorney and guardianship. I personally do not believe as long as her daughter is still recovering that she should keep the power of attorney and the guardianship, her daughter does not at this time need to have pressure put on her by you, if you care about here then wait until she has a complete recovery, and take one day at a time. The mother may have concerns as to why you decided to date her daughter after the accident and not before, also if her daughter is taking alot of medication she is not able to make decitions on her own and if I were her mother I would not want my daughter dating at all after she had this kind of serious accident a little alone allow my daughter to except a marriage propsal, and she is correct her daughter should not be going to your home and spending the night, until this girl gets a complete recovery and off her medications for pai etc, and she is walking on her own, and knowing that there will not be any more brain surgey's then she should not have any seriuos relationship with you. You need to see how she feels about you and marriage when she is completey recovered let her mother take care of her she needs her mother more than she needs you right now respect her and her mother and step back, I am not sujesting you not see her just step back, I am to concerned as to why you would start dating a girl you new and yet only started to date after the accident, when she has been going though surgies, and on medication that effects her thinking.

I was trying to explain to you how her mother may feel, and because I do not know you I was curious as well, thanks for clariflying this, I hope you can understand where I am coming from with sujesting you take time and respect her mother and her, she can like you even love you she has excepted your propsoal just give her time to completely heal she will respect this and when she recovers then you both can make plans for the futore, I canot tell you what to do, this was and is just a sujestion, she needs all the support she can get, understand where her mothers coming from she could of lost her daughter, I was there once and completely understand where the mother is coming from, once a mother alwways a mother hopefully she will be there for you if you ever need her as she is with her daughter, sure she will love you to.

See most of this my fiance is bothered by, she is upset at what her mom is doing and how she is using her guardianship. It bothers me too but yes I do understand what you are saying and am putting her well being first and her recovering. The proposal was fine, my fiance keeps asking her mom to stay over nights with me. And i do know her mom automatically things its to be physical, like anyone would. But its not the case and if she brings it up I will point that out. I am supporting my fiance 100%
